Apart from the special Treaty sMligations in the ease
of Spain and Switserland which have been referred to, there is
no expressed obligation to furnish legal aid without charging
for it, and a different course might, no doubt, be defended;
but, in Mr. McKenna's view a liberal interpretation of the
obligations resting on H.M. Gevermant under the Law and
Extradition Treaties is desirable as tending to maintain
relations of friendliness and mutual helpfulases with other
Governments in regard to extradition proceedings.
It is also to be remarked that an application for
Habeas Corpus may raise questions of general importance that
should not be decided by the High Court without being fully
argued by Counsel, and serious difficulty might besult from
leaving the employment of Counsel to resint the application
to the discretion of a foreign Government.
